General
All orders and enquiries are subject to availability and confirmation. Upon receipt by the purchaser of an order confirmation or invoice detailing the full specification of the order, a contract shall exist between Terramar Organics and the purchaser. If you would like to personalise your order please contact us for further information. We can also source goods not listed on our website as long as they conform with our ethical purchasing criteria.
Definitions
"Purchaser", "you", "your", shall herein be construed as meaning: the "buyer" i.e. person(s) or a body corporate/corporate body seeking to purchase from Terramar Organics.
"Us", "our", "we", shall herein be construed as meaning: the "seller" i.e. "Terramar Organics".
1 Payment Options
1.1 Upon receipt of your order an order confirmation or invoice will be sent to you and goods will be dispatched to you on the date specified. At this stage a legally binding contract shall exist between us and you.
1.2 First-time orders - Prior to delivery of the goods, Terramar Organics must receive payment for the full price of the goods ordered as detailed in the order confirmation or invoice. Payment terms thereafter, as agreed on an order-by-order basis.
1.3 Cheque/Postal Order - Make cheques payable to "Terramar Organics". Please detail purchaser name, delivery address and invoice number on rear.
1.4 Paypal - (credit, debit card or foreign currency payments – charges may apply) to be made in Sterling (GBP) (unless otherwise agreed). Instructions for payment by Paypal will be detailed on your order confirmation/invoice.
1.5 BACS - (electronic payment transfer) Call: 07999613982 for details. This is our preferred means of payment.
1.6 All cheques and postal orders must be made payable to "Terramar Organics". Your order will be dispatched when the funds have cleared. Payment by cheque shall be construed as having been received at the time that Terramar Organics’ bankers receive the funds from the purchaser’s bankers.
2 Delivery
2.1 We accept orders for delivery within the United Kingdom, to Europe (the EU), and North America (USA and Canada). Goods will be delivered to the address as detailed in the order confirmation or invoice. Unfortunately, we cannot guarantee delivery to all locations – you will be contacted by Terramar Organics if there is a problem with your delivery location/address.
2.2 Customs charges may apply if delivery is to a non-EU destination and shall be paid for by the customer.
2.3 Estimated delivery is within 7 working days of receipt of payment but this may vary from order to order – see order confirmation or invoice for details or contact us. Delivery must be to an address where the delivery can be signed for. Charges vary depending on the particular order and are set out in the order confirmation/invoice.
3 Ownership
3.1 Ownership of the goods ordered shall pass from Terramar Organics to the purchaser upon payment of the full price of the goods and delivery of the goods to the delivery address provided in the order confirmation/invoice or on delivery into custody on the purchasers' behalf (whichever is sooner).
4 Risk
4.1 Goods supplied by Terramar Organics shall be at the purchasers risk immediately on delivery to the purchaser or on delivery into custody on the purchasers’ behalf (whichever is the sooner) and the purchaser should therefore be insured accordingly.
5 Events beyond our reasonable control – Force Majeure
5.1 We shall not be liable for any circumstances beyond our reasonable control, which may result in damage or defect of the goods, or cause delay or failed delivery, or result in any loss by you or any third party. Such events include, but are not limited to, acts of terrorism, forces of nature, industrial disputes, strikes, and insurgency.
5.2 We assume no responsibility for consequential loss or damage.
6 Claims
6.1 Shortages or damaged goods must be reported initially by telephone within 48 hours of receipt and confirmed in writing within 3 days of receipt. Non-Delivery must be reported within 10 days of delivery date and confirmed in writing within 14 days of delivery date. Claims made outside these limits may not be accepted by Terramar Organics.
7 Cancellation and Return
7.1 Please contact us if you feel you have reason to return or cancel your order. However, we do not normally accept cancellations or returns of orders made to customers specification, unless there are reasonable grounds to do so. Administration and re-stocking costs may apply if an order is cancelled or returned.
7.2 Unless otherwise agreed, orders delivered to the purchaser’s specification may only be returned if goods are not of satisfactory quality or are not as specified in the order confirmation or invoice.

9 Jurisdiction and Applicable Law
9.1 A legally binding contract shall exist between you (the customer) and Terramar Organics upon receipt by you of the order confirmation or invoice and shall subsist until it expires as herein provided.
9.2 Terramar Organics is based in and operates in Scotland. The law governing the contract between Terramar Organics and you shall be Scottish Law and the Scottish Courts shall have jurisdiction to resolve any legalities and liabilities arising between Terramar Organics and you.
10 Privacy
10.1 In order to process your orders, we require of you certain personal data such as customer name, email address, address and telephone number. We shall only use this data for processing your order, contacting you in connection with the order, or as required to by law.
10.2 We have absolute respect for your privacy and confidentiality. We shall comply with the relevant data protection legislation including the Data Protection Act 1998 and relevant EU legislation on data protection and privacy. None of the information provided to us shall be disclosed to any third parties; in particular, Terramar Organics shall not disclose your personal data to any other companies, organisations, businesses, with the exception of being compelled to do so by law.
10.3 We will never collect sensitive information about you without your explicit consent.
11 Amendments and Changes
11.1 Terramar Organics may make improvements or changes to the information, services, products and other materials on this website, or terminate this website at any time without notice. If, in the case that the website is terminated, all outstanding orders will be honoured.
11.2 We may also modify these terms and conditions at anytime. Any such modification shall be effective immediately upon posting of the modified terms and conditions on this website. Accordingly, your continued access or use of this website is deemed to be your acceptance of the modified terms and conditions.
